TERMS AND CONDITIONS
These Terms and Conditions (Terms) are a legal contract between Payost (we, us, or our) and the customer (you or your) for us to provide you with online payment services.
“Payost“ is a web-based platform, managed by us, which end-users may use as a gateway which is a secure and straightforward way to move funds online.
The agreement will be active from the date of its reception by you (“Effective Date”). By agreeing to Accept or Agree where this option is made accessible to you by us through the website for the Platform which you at this moment adopt as your electronic signature you consent and agree to the terms and conditions of the present Legal Agreement and therefore the electronic document of the agreement is deemed as duly signed by you.
Eligibility for Payost Platform
To be qualified to use any functionalities of the Payost Platform, you must (i) be at least 18 years old; and (ii) you must be eligible to access the Payost payment services.
Upon enrolling for the Platform and during this agreement, you must provide current, comprehensive and accurate data by personalizing your Online account, as requested by us and maintain that information as existing and correct during the use of the Platform.
You may not use the Platform and may not accept the agreement, and we may tentatively stop or discontinue the Platform and Agreement immediately and without earlier announcement to you, if:
(a) You are not of legal age to form a binding contract with us and operate the payment device or funding tool for use with the Platform; or
(b) You are a person prohibited from receiving the Platform under the applicable laws or regulations, with the provisions of the entity which provides the e-money and payment services, or our rules or policies;
(c) You have not been fully recognized or confirmed by us, upon our single responsibility; or
(d) Other important reasons, upon our discretion, such as risk and compliance;
Disclaimer of Warranties
You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output and for maintaining a means external to our site for any reconstruction of any lost data. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the website any services or items obtained through the sites.
Your use of the website, it’s content, and any services obtained through the website are at your own risk. The website, its content and any services obtained through the website are provided on an “as is” and “as available” basis, without any warranties of any kind, either expressed or implied. Neither the Company nor any person associated with the company makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the website. Without limiting the foregoing, except to the extent required by law, neither Payost nor anyone associated with Payost represents or warrants that the website, its content or any services or items obtained through the website will be accurate, reliable, error-free or uninterrupted, that defects will be corrected, that our site or the server that makes it available are free of viruses or other harmful components or that the Application or any services or items obtained through the Application will otherwise meet your needs or expectations.
Payost as a result of this disclaims all warranties of any kind, either expressed or implied, statutory or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for a particular purpose.
Liability and Limitation of Liability
Except as otherwise required by law, Payost’s liability is limited to the U.S. dollar amount showing on the face of receipt for your money transfer transaction, including service charges. Except as provided in the previous sentence, in no event will the company, its affiliates or their licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the website or any websites linked to them. Any content on the website or such other websites or any services obtained through the website, or such other websites, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
If Payost does not properly complete transactions on time or in the correct amount in accordance with this agreement with you, Payost may be liable for your losses, up to the limitation described in the preceding paragraph. However, Payost will not be liable if (a) through no fault of Payost, you do not have enough funds available in your bank account, debit card account, or credit card account to complete the transaction; (b) the paying agent or recipient refused to accept your money transfer; (c) the paying agent or recipient refused to complete the transaction; (b) the paying agent or recipient refused to receive your money transfer; (c) your funds are subject to legal process or other encumbrances restricting transfer; (d) you provide incorrect or incomplete transaction information to Payost; or (e) if your use is not an Acceptable Use.
The previous does not affect any liability which cannot be excluded or limited under applicable law.
